PerQ Customer Terms of Use

Terms for customers using a PerQ loyalty card

1. Who We Are

PerQ is a digital loyalty card platform operated by Retail Geek Ltd, a company registered in England and Wales (Company Number: 16740532), with its registered address at 14 Upper Park Street, Cheltenham, GL52 6SB.

PerQ provides the technology that allows retailers to run digital loyalty card schemes using Apple Wallet and Google Wallet. The loyalty scheme itself is operated by the individual retailer, not by Retail Geek Ltd.

2. Accepting These Terms

By signing up for a loyalty card through the PerQ platform, you agree to these terms. If you do not agree, do not sign up.

3. How PerQ Works

When you sign up for a retailer's loyalty card through PerQ:

4. The Loyalty Scheme is the Retailer's Responsibility

The loyalty scheme — including the rewards offered, the number of stamps required, and any conditions attached — is set and operated by the retailer, not by Retail Geek Ltd.

Retail Geek Ltd provides the technology platform only. Any queries about rewards, stamp validity, or scheme changes should be directed to the retailer directly.

5. Stamps and Rewards Have No Cash Value

Stamps collected and rewards earned through PerQ have no monetary value and cannot be exchanged for cash. They can only be redeemed for the specific reward offered by the retailer.

Stamps and rewards are non-transferable and cannot be sold, gifted, or combined with another person's account.

6. Changes to the Loyalty Scheme

The retailer may change the terms of their loyalty scheme at any time, including the number of stamps required, the rewards available, or the expiry of stamps. Retail Geek Ltd is not responsible for any such changes.

A retailer may also end their loyalty scheme entirely. If this happens, any unclaimed stamps or rewards will be lost. Retail Geek Ltd accepts no liability for this.

7. Your Account

Your loyalty card is linked to the phone number you provided at sign-up. You are responsible for ensuring your details are accurate.

Each person may hold one loyalty card per retailer. Creating multiple accounts for the same retailer is not permitted.

If you lose access to your wallet pass, you can re-add it by scanning the retailer's QR code again. Your stamp history will be restored.

8. SMS Marketing

If you gave your consent to receive marketing messages at sign-up, the retailer may send you SMS messages about offers, promotions, and updates.

You can withdraw your consent and stop receiving messages at any time by replying STOP to any message you receive.

Withdrawing marketing consent does not affect your loyalty card or your accumulated stamps.

9. Misuse

You must not attempt to manipulate, exploit, or abuse the PerQ platform, including by tampering with QR codes, creating fraudulent accounts, or attempting to claim stamps or rewards you are not entitled to.

Retail Geek Ltd reserves the right to suspend or terminate your loyalty card if misuse is suspected.

10. Your Personal Data

Your personal data is handled in accordance with our Customer Privacy Notice. Please read it to understand how we collect, use, and protect your information.

11. Our Liability

Retail Geek Ltd provides the PerQ platform on an "as is" basis. We do not guarantee uninterrupted availability of the service.

We are not liable for:

12. Changes to These Terms

We may update these terms from time to time. The latest version will always be available at this URL. Continued use of a PerQ loyalty card after changes are posted means you accept the updated terms.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
